{"id":1122,"date":"2025-12-29T17:29:08","date_gmt":"2025-12-29T16:29:08","guid":{"rendered":"https:\/\/www.cabinet-bessis.com\/?p=1122"},"modified":"2025-12-29T18:51:42","modified_gmt":"2025-12-29T17:51:42","slug":"transport-aerien-limpact-de-foudre-est-une-circonstance-extraordinaire-exoneratoire","status":"publish","type":"post","link":"https:\/\/www.cabinet-bessis.com\/en\/transport-aerien-limpact-de-foudre-est-une-circonstance-extraordinaire-exoneratoire\/","title":{"rendered":"Transport a\u00e9rien : l&#8217;impact de foudre est une circonstance extraordinaire exon\u00e9ratoire"},"content":{"rendered":"<p data-start=\"742\" data-end=\"1099\">Par un <strong>arr\u00eat du 16 octobre 2025 <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/fr\/TXT\/?uri=CELEX:62024CJ0399\" target=\"_blank\" rel=\"noopener\"><em>AirHelp Germany <\/em>(C-399\/24)<\/a><\/strong>, la <strong data-start=\"782\" data-end=\"823\">Cour de justice de l\u2019Union europ\u00e9enne<\/strong> retient qu\u2019un <strong data-start=\"839\" data-end=\"874\">impact de foudre sur un a\u00e9ronef<\/strong> constitue une <strong data-start=\"889\" data-end=\"920\">circonstance extraordinaire<\/strong> au sens de l\u2019article 5 \u00a7 3 du <strong data-start=\"951\" data-end=\"981\">r\u00e8glement (CE) n\u00b0 261\/2004<\/strong>, d\u00e8s lors qu\u2019il entra\u00eene des inspections de s\u00e9curit\u00e9 r\u00e9glementaires retardant la remise en service de l\u2019appareil.<\/p>\n<hr \/>\n<h2 data-start=\"1263\" data-end=\"1307\">1. Cadre juridique<\/h2>\n<p data-start=\"1308\" data-end=\"1443\">Le r\u00e8glement 261\/2004 instaure un <strong data-start=\"1342\" data-end=\"1378\">r\u00e9gime d\u2019indemnisation objective<\/strong> des passagers en cas de retard important ou d\u2019annulation de vol.<\/p>\n<p data-start=\"1445\" data-end=\"1554\">L\u2019exon\u00e9ration du transporteur est subordonn\u00e9e \u00e0 la r\u00e9union de <strong>deux conditions cumulatives<\/strong> :<\/p>\n<ol data-start=\"1555\" data-end=\"1766\">\n<li data-start=\"1555\" data-end=\"1654\">\n<p data-start=\"1558\" data-end=\"1654\">la survenance d\u2019un <strong data-start=\"1575\" data-end=\"1651\">\u00e9v\u00e9nement non inh\u00e9rent \u00e0 l\u2019exercice normal de l\u2019activit\u00e9 du transporteur <\/strong>;<\/p>\n<\/li>\n<li data-start=\"1655\" data-end=\"1766\">\n<p data-start=\"1658\" data-end=\"1766\">un \u00e9v\u00e9nement <strong data-start=\"1671\" data-end=\"1708\">\u00e9chappant \u00e0 sa ma\u00eetrise effective<\/strong>, m\u00eame en pr\u00e9sence de mesures organisationnelles adapt\u00e9es.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"1768\" data-end=\"1837\">La charge de la preuve p\u00e8se int\u00e9gralement sur le transporteur a\u00e9rien.<\/p>\n<h2 data-start=\"1768\" data-end=\"1837\">2. Circonstances du litige et question pr\u00e9judicielle<\/h2>\n<p data-start=\"1896\" data-end=\"2085\">L\u2019affaire concerne un vol avec correspondance <strong data-start=\"1944\" data-end=\"1971\">Ia\u0219i<\/strong> (Roumanie) \u2013<strong data-start=\"1944\" data-end=\"1971\"> Vienne \u2013 Londres<\/strong>.<\/p>\n<p data-start=\"1896\" data-end=\"2085\">L\u2019a\u00e9ronef qui devait effectuer le vol Ia\u0219i &#8211; Vienne a \u00e9t\u00e9 <strong data-start=\"2022\" data-end=\"2046\">frapp\u00e9 par la foudre<\/strong> lors du vol pr\u00e9c\u00e9dent obligeant la compagnie a r\u00e9aliser une inspection de s\u00e9curit\u00e9 permettant de d\u00e9tecter un dommage sur un instrument ext\u00e9rieur critique. Cet incident l&#8217;a conduit \u00e0 immobiliser l\u2019appareil puis \u00e0 affr\u00e9ter un avion de remplacement.<\/p>\n<p data-start=\"2278\" data-end=\"2513\">Cet incident a entra\u00een\u00e9 un retard sup\u00e9rieur \u00e0 sept heures et donc la perte de la correspondance pour le passager demandeur.<\/p>\n<p data-start=\"2278\" data-end=\"2513\">Saisie par la juridiction autrichienne, la CJUE devait d\u00e9terminer si un <strong data-start=\"2428\" data-end=\"2448\">impact de foudre<\/strong> relevait des circonstances extraordinaires au sens du r\u00e8glement 261\/2004.<\/p>\n<h2 data-start=\"2520\" data-end=\"2573\">3. Qualification juridique de l\u2019impact de foudre<\/h2>\n<p data-start=\"2574\" data-end=\"2624\">R\u00e9ponse de la CJUE : <strong>Oui<\/strong>, la foudre constitue une <strong>circonstance extraordinaire<\/strong> susceptible d&#8217;exon\u00e9rer la responsabilit\u00e9 du transporteur a\u00e9rien.<\/p>\n<p data-start=\"2574\" data-end=\"2624\">Elle retient les circonstances suivantes :<\/p>\n<ul>\n<li data-start=\"2628\" data-end=\"2766\"><strong data-start=\"2628\" data-end=\"2662\">\u00c9v\u00e9nement ext\u00e9rieur et naturel<\/strong> : la foudre constitue un ph\u00e9nom\u00e8ne m\u00e9t\u00e9orologique ind\u00e9pendant de la sph\u00e8re d\u2019influence du transporteur.<\/li>\n<li data-start=\"2769\" data-end=\"2967\"><strong data-start=\"2769\" data-end=\"2814\">Absence d\u2019inh\u00e9rence \u00e0 l\u2019activit\u00e9 a\u00e9rienne<\/strong> : bien que les a\u00e9ronefs soient certifi\u00e9s pour r\u00e9sister \u00e0 la foudre, l\u2019impact ne rel\u00e8ve pas du fonctionnement normal du transport a\u00e9rien.<\/li>\n<li data-start=\"2769\" data-end=\"2967\"><strong data-start=\"2970\" data-end=\"3010\">Primaut\u00e9 des obligations de s\u00e9curit\u00e9<\/strong> : ce sont les inspections r\u00e9glementaires impos\u00e9es apr\u00e8s l\u2019impact, et non une d\u00e9faillance technique intrins\u00e8que, qui sont \u00e0 l\u2019origine du retard.<\/li>\n<\/ul>\n<p data-start=\"3156\" data-end=\"3275\">La Cour pr\u00e9cise que la <strong data-start=\"3179\" data-end=\"3204\">fr\u00e9quence statistique<\/strong> des impacts de foudre est indiff\u00e9rente.<\/p>\n<h2 data-start=\"3282\" data-end=\"3353\">4. Appr\u00e9ciation des mesures raisonnables<\/h2>\n<p data-start=\"3354\" data-end=\"3473\">La caract\u00e9risation d\u2019une circonstance extraordinaire n\u2019exon\u00e8re cependant pas automatiquement le transporteur.<\/p>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Il lui faut \u00e9galement de\u0301montrer que <strong>(i)<\/strong> cette circonstance n\u2019aurait pas pu e\u0302tre e\u0301vite\u0301e me\u0302me si toutes les &#8220;mesures raisonnables&#8221;
