Iberia<\/em>)<\/strong>, the Court held that <strong>pets must be regarded as \u201cbaggage\u201d <\/strong>within the meaning of <strong>the Montreal Convention of May 28, 1999<\/strong>.<\/p>\n<p>The judgment is available <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A62024CN0218\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>This clarification has significant practical implications: in cases of loss or damage, the airline\u2019s liability is capped, just as it is for any other checked baggage.<\/p>\n<h3><strong>1. Background: when the animal \u201cdisappears\u201d in transit<\/strong><\/h3>\n<p>A passenger was traveling with her mother and her dog on a Buenos Aires\u2013Barcelona flight operated by Iberia.<\/p>\n<p>The animal, checked into the hold, escaped during transfer to the aircraft and was never found.<\/p>\n<p>The passenger sought <strong>\u20ac5,000 in compensation<\/strong> for emotional distress. Iberia acknowledged liability but limited it to the cap set by the Montreal Convention, i.e. <strong>1,519 Special Drawing Rights-SDR (approximately \u20ac1,870)<\/strong>.<\/p>\n<p>The Madrid Commercial Court referred a question to the CJEU: can a pet be treated as baggage under the Convention?<\/p>\n<h3><strong> 2.
